The land sits on a 1984 lease originally granted by the defunct Narok County Council to Ol Kiombo Ltd, a company associated with Livingstone Kunini Ole Ntutu — a relative of current Narok Governor Patrick Keturet Ole Ntutu, the same governor who in 2023 signed the moratorium into law that his family's lease then bypassed. The Court of Appeal in July 2025 ruled the Ntutu family is entitled to billions of shillings in tourism revenue from 4,720 acres of disputed reserve land. NEMA's "public participation" record for the project contains at least one forged signature: Maasai herder Julius Manchau Liaram told the New York Times he never attended the consultation meeting his name appears on, and filed a police report. The lead petitioner, Dr. Meitamei Olol Dapash, was placed under a "temporary gag order" in November 2025, withdrew his suit December 16, was refused withdrawal, then had the case dismissed on procedural grounds February 26, 2026 — with full trial costs awarded against him. The same Felix Koskei was, as of May 2026, being reported by Kenya's KTN for a separate 9,000-acre matter at the collapsed Miwani Sugar estate — described as using a similar pattern: contested documents, a creditor ("Nagenda Saxena") that DCI reportedly determined does not exist as a real person, and a Cabinet override of an active court case.
