These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MagnaHistoria ("we," "us," "our," or the "Company"), governing your access to and use of the MagnaHistoria platform, including the website located at magnahistoria.com, all associated web applications, voice guides, data visualizations, audio content, and related services (collectively, the "Service").
By creating an account, subscribing to a plan, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
To access certain features of the Service, you must create an account using Google OAuth or email magic link authentication, as provided through our authentication partner, Supabase. You agree to:
We reserve the right to suspend or terminate accounts that we reasonably believe violate these Terms or are being used fraudulently.

Conversation limits reset monthly from the date of subscription activation. Unused conversations do not roll over to subsequent billing periods.
All payments are processed securely through Stripe, Inc. We do not directly store your full credit card number, debit card number, or bank account information on our servers. By providing payment information, you authorize us to charge the applicable subscription fees to your designated payment method on a recurring monthly basis.
You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:
Subscription fees are generally non-refundable. However, we may issue refunds at our sole discretion in cases of documented service outages, billing errors, or other exceptional circumstances. Refund requests must be submitted within 14 days of the charge in question by contacting support@magnahistoria.com.
We reserve the right to modify subscription pricing at any time. We will provide at least 30 days' notice before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.
All content produced by the voice guides — including spoken dialogue, narrative content, historical interpretations, and coaching responses — is generated by advanced conversational technology and is provided strictly for educational, entertainment, and personal development purposes. Such content:
When you interact with our voice guides, your voice input is transmitted to our voice processing provider for processing and response generation. By using the voice agent features, you acknowledge and consent to the following:
The Service features multiple guides with distinct personas, voices, and interaction styles. These personas are fictional characterizations designed to create an engaging experience. The agents' statements, opinions, and narratives do not represent the views, beliefs, or positions of MagnaHistoria or its operators.
The Service includes personal coaching functionality that allows you to define goals (e.g., fitness, personal development, habit formation) and receive motivation and accountability through voice guide interactions. You understand that:
The Service includes optional biometric measurement features that use your device's camera to estimate physiological metrics such as heart rate (HR) and heart rate variability (HRV) through a technique called remote photoplethysmography (rPPG). All content, data, visualizations, maps, datasets, audio recordings, narrative text, design elements, software, and other materials available through the Service (collectively, "Platform Content") are owned by or licensed to MagnaHistoria and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, or publicly display Platform Content without our express written permission.
You retain ownership of any content you submit through the Service, including coaching goals and profile information. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely for the purpose of providing and improving the Service.
If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, irrevocable, perpetual license to use such feedback for any purpose without compensation to you.
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, with the arbitration taking place in New York, New York.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
